Hi Maryann:

Don't hold me to this (and maybe Vincent and other lawyers Mark and Joanna can weigh in on this), but I seem to recall reading an article recently which said that if a tree on one's property falls on somebody else's property, it's the problem of the person on whose property the tree fell. So I'm not sure that we have any responsibility here to remove the fallen tree, but If we (the Association) are going to remove the tree, we should probably get permission of people who own that property? I personally wouldn't do anything re that fallen tree unless neighbor asks us to? Would love to hear what Vincent thinks? Also Joanna? Mark? (I am recovering labor lawyer, not property lawyer).

On Sun, Oct 1, 2023 at 4:02 PM Maryann Dabkowski via Everyone <everyone@chelseaplacedecatur.com> wrote:

Hi everyone-
A branch on one of the trees in the alley by my townhouse just fell into my neighbor's backyard. It doesn't appear anyone is hurt or there's any significant property damage; it fell on a fire pit. I'm not sure if it's a tree on our communal property or belongs to someone on the other side of the fence? Not sure what responsibility we have here so hoping someone who has been here longer has some idea.
