My home insurance carrier at that time refused to pay for the damages as they stated it was an act of God. They informed me that in a future similar situation, I should always send a certified (friendly) letter with a copy mailed back to me (unopened) to my neighbor, informing them of my concerns about their tree. If nothing is done about the tree, and if it does damage to my property, then the copy of the unopened, certified letter is turned over to my insurance company to insure full coverage for damages. Fortunately, the City of Decatur will take action if the neighbor is uncooperative after the letter is sent. (My apologies for being so lengthy. )</span>

Don't hold me to this (and maybe Vincent and other lawyers Mark and Joanna can weigh in on this), but I seem to recall reading an article recently which said that if a tree on one's property falls on somebody else's property, it's the problem of the person on whose property the tree fell. So I'm not sure that we have any responsibility here to remove the fallen tree, but If we (the Association) are going to remove the tree, we should probably get permission of people who own that property? I personally wouldn't do anything re that fallen tree unless neighbor asks us to? Would love to hear what Vincent thinks? Also Joanna? Mark? (I am recovering labor lawyer, not property lawyer).
